Katie A. v. Bontá Settlement Agreement History

In July 2002, a class action lawsuit was filed seeking to improve access to mental health and social services for children in intermediate placement or foster care. An agreement was reached in 2011 that requires that Medi-Cal provides all foster children and those at risk of entering into foster care, receive in-home and community-based services. In compliance with existing federal law, each child is entitled to receive early periodic screening, diagnosis, and treatment to design an individualized care plan that takes into consideration any mental health services they may need. Although mandated, this result of the lawsuit promotes a systemic change to increase the collaboration between child welfare services and mental health departments. Both systems of care are engaging children and their families in the development of the child’s care plan.
